Direct bookings
Booking Terms & Conditions
These terms apply to stays booked directly with us through moffatts.place, by email or by phone. If you booked through Airbnb, Stayz or another platform, that platform’s terms and cancellation policy apply instead.
In these terms, “we”, “us” and “our” means the owner of Moffatts Place of Billinudgel. “You” means the person making the booking (the lead guest) and, where it makes sense, everyone staying with you.
1. Your booking
1.1When you request a booking on our website, we hold your dates and email you a confirmation with a secure payment link. Your booking is confirmed once you have paid the 50% deposit (or the full amount). If the deposit isn’t paid within 48 hours of us sending the link, the hold lapses and the dates are released. By paying, you agree to these terms on behalf of everyone in your group.
1.2The lead guest must be at least [21] years old, must stay at the property for the whole booking, and is responsible for the group following these terms.
1.3Please check your confirmation carefully and tell us straight away if anything is wrong.
2. Rates, fees and payment
2.1What you pay. Your total is the nightly rate for each night booked plus a $200 cleaning fee per stay. All prices are in Australian dollars. [Prices include GST. / We are not registered for GST, so no GST is charged.]
2.2No platform service fees. Booking direct means no booking-site guest service fees. The price we quote is the price you pay, apart from any card surcharge in clause 2.6 and any optional extras you choose.
2.3Minimum stays. Minimum stays vary by season and are shown when you book. Any stay that includes a night between 14 December and 31 January has a minimum of 5 nights.
2.4Deposit and balance. You pay 50% when you book and the balance 30 days before arrival. If you book within 30 days of arrival, you pay the full amount when you book.
If you book through Airbnb or another booking site, that site’s payment schedule applies instead, but the cancellation policy in clause 4 is the same.
2.5Late balance. We will remind you before the balance is due. If it is still unpaid 7 days after the due date, we may cancel the booking. Clause 4 then applies as if you had cancelled on the due date.
2.6How you pay. You pay by card using the secure payment link we email you. Payments are processed by Stripe through our booking system, Lodgify, and the balance is charged or requested on the due date. [A card surcharge of X% applies, which is no more than our cost of accepting the card. / We do not charge a card surcharge.] We never see or store your full card number.
2.7Rate changes. Once your booking is confirmed, we won’t change your price, even if our published rates change later.
3. Damage
3.1We don’t take a security bond. We trust our guests to look after the place as if it were their own.
If you book through Airbnb, damage is handled through Airbnb’s own damage protection process instead.
3.2You are responsible for damage, missing items or a breach of the house rules during your stay that costs us money to fix. We will tell you within 7 days of check-out if we find any.
3.3Before we ask you to pay for anything, we will send you photos, an itemised list and the receipts or quotes. You will have a fair chance to respond. We will only charge reasonable costs. Fair wear and tear and genuine accidents reported to us promptly are treated sympathetically.
3.4You agree to pay reasonable costs within 14 days of receiving our itemised claim.
3.5Extra cleaning fees apply only where the property is left in a condition well beyond a normal holiday clean-up, for example smoking indoors, pet hair from an unapproved pet, or rubbish left behind. We will tell you the amount and show you photos.
4. Cancellations and refunds
4.1 If you cancel
To cancel, email us. The date we receive your email is the cancellation date.
Our cancellation policy is the same as Airbnb’s Firm policy, so it’s the same wherever you book.
| When you cancel | Refund |
|---|---|
| 30 days or more before check-in | Full refund |
| 7 to 30 days before check-in | 50% refund of the total booking |
| Less than 7 days before check-in | No refund (but see re-letting below) |
- Cleaning fee. If you cancel before arrival, we always refund any cleaning fee paid.
- Re-letting. If you cancel inside a “50% refund” or “no refund” period, we will try to re-let the nights. If we re-let them, we will refund what we receive for those nights, up to the amount you paid, less any discount we had to offer to re-let them.
- Date changes. You can ask to move your dates instead of cancelling. If you move them 30 or more days before check-in, we will do it once with no fee, subject to availability and the new dates’ rates. A change that shortens your stay inside the cancellation periods counts as a part cancellation.
- Leaving early. We don’t refund unused nights if you leave early by choice, but the re-letting rule above still applies.
- Refunds go back to the card you paid with within 10 business days. Card surcharges are refunded along with the amount they were charged on.
4.2 If we cancel
If we have to cancel your booking for any reason other than a breach of these terms, we will refund everything you have paid in full. We will also do our best to help you find other accommodation nearby.
4.3 Floods, fires, road closures and other events outside anyone’s control
The Northern Rivers can be hit by floods, storms and bushfires. If, for any night of your stay:
- the property is damaged or unsafe to stay in;
- the property cannot reasonably be reached because roads are closed (for example Billinudgel or Brunswick Valley Way flooding); or
- a government order, emergency warning to evacuate or official travel restriction stops you from staying or travelling to the area,
you can choose a full refund for the affected nights or a credit for a future stay that is valid for [18] months. If the event happens during your stay and you have to leave, we will refund the unused nights.
If the property is safe and reachable and you choose not to travel, for example because of a forecast or bad weather, our normal cancellation policy applies.
4.4 Travel insurance
We strongly recommend travel insurance that covers cancellation. It protects you in cases that our policy doesn’t cover, such as illness or changed plans.
4.5 Your consumer rights
Nothing in these terms excludes, restricts or changes any right or remedy you have under the Australian Consumer Law, including consumer guarantees that cannot be excluded. Our cancellation charges are set to reflect the genuine loss we expect to suffer when nights are cancelled at short notice.
5. Arrival, departure and occupancy
5.1Check-in is from 2:00 pm and check-out is by 12:00 pm. Ask us about early check-in or late check-out. We will help where we can, but we can’t guarantee it.
5.2We will send you arrival instructions, including access details and directions, about 3 days before your stay.
5.3Maximum 6 guests, including children. Infants under 2 are welcome by arrangement. Only guests named on the booking may stay overnight.
5.4Day visitors are welcome with our approval first. Please keep it to no more than [8] people on site in total, and make sure visitors leave by 10:00 pm.
6. House rules
6.1No parties or events. Moffatts is a quiet rural home with neighbours. Parties, functions and gatherings beyond your booked group are not allowed unless we have agreed to them in writing, for example a private catered dinner arranged through us.
6.2Quiet hours are 10:00 pm to 7:00 am. Please keep outdoor noise and music low at all times. Sound carries a long way in the hinterland.
6.3No pets. Assistance animals are always welcome. Just let us know they’re coming.
6.4Smoking and vaping are only allowed outdoors, away from doors and windows. Please use the bin provided for butts. Dropped butts are a real fire risk on a rural property.
6.5Fire pit and BBQ.
- Use the fire pit only in the designated pit, and use only the firewood we provide.
- Never light the fire pit on a Total Fire Ban day or when the NSW Rural Fire Service has banned open fires. You can check the current rating at rfs.nsw.gov.au.
- Never leave a fire unattended, and supervise children near it at all times.
- Put the fire out completely with water before you go to bed or leave the property.
- Turn off the BBQ gas at the bottle after each use.
6.6Pool. The pool gate must be kept shut at all times. There is no lifeguard: you swim at your own risk.
- Children must be actively supervised by an adult whenever they are in or near the pool. Never prop the pool gate open.
- No diving, no glass in the pool area, and no swimming after drinking alcohol or at night without lighting.
- Please don’t touch the pool equipment or chemicals. Tell us straight away if anything looks wrong with the water, gate or fence.
6.7Tank water and septic. The property may rely on rainwater tanks and an on-site septic system. Please use water sensibly. Only toilet paper goes down the toilet. No wipes, sanitary items or nappies, even ones labelled “flushable”. If we have to fix a blockage caused by these items, the cost may be charged against the bond.
6.8Rural property. You are staying on a rural property with gardens and a native plant nursery. Please:
- watch for snakes, ticks, insects and other wildlife, and check yourselves for ticks after walking in long grass;
- supervise children outdoors, especially near garden areas, tools and the fire pit;
- stay out of the nursery and shade house, sheds and any areas we have marked as private, unless we take you there.
6.9Please treat the home with care, keep the doors locked when you go out, and report any breakage or problem promptly. Most problems can be fixed quickly if we know about them.
6.10Breaking the rules. Serious or repeated breaches can lead to the booking being ended without a refund for the remaining nights, and can be reported under the Code of Conduct in clause 8. Serious breaches include parties, too many guests, fire or pool safety breaches, threatening behaviour, or illegal activity.
7. Optional extras
7.1We don’t offer paid extras at the moment. If we add any later, they will be billed separately and only provided if you ask for them. Some may be provided by third parties with their own terms, which we will tell you about before you book them.
8. Short-term rental Code of Conduct
8.1Moffatts Place is registered on the NSW Short-term Rental Accommodation Register (registration number PID-STRA-90928). It is run in line with the NSW Short-term Rental Accommodation Industry Code of Conduct. The Code sets out obligations for hosts and guests, including rules about noise, behaviour and respecting neighbours. Guests who seriously breach the Code can be placed on the NSW STRA exclusion register.
8.2You can read the Code on the NSW Fair Trading website.
9. Liability
9.1You are responsible for any loss or damage to the property, its contents or neighbouring properties caused by you, your group or your visitors. This doesn’t include fair wear and tear.
9.2You use the property and its facilities, including the fire pit, BBQ, gardens and grounds, at your own risk, except where we have been negligent or where the law says otherwise.
9.3We are not responsible for loss of or damage to your belongings, except where it is caused by our negligence.
9.4Things like internet, mobile coverage, power and water supply can be interrupted in rural areas. We will fix any problem within our control as quickly as we can. A short interruption that is outside our control is not grounds for a refund. If an interruption makes the property unfit to stay in, we will work out a fair outcome with you in line with clause 4.5.
9.5This clause doesn’t limit any rights you have under the Australian Consumer Law (see clause 4.5).
10. Privacy
10.1We collect your name, contact details, guest numbers and booking details so we can manage your stay. We use them only for that purpose and to meet our legal obligations. If you choose to join our mailing list, we will also send you occasional news, and you can unsubscribe at any time.
10.2Bookings and payments are managed in our booking system, Lodgify. Card payments are handled by Stripe, which processes your card details under its own privacy policy. We do not store full card numbers.
10.3We don’t sell your information. We only share it where we need to in order to deliver your stay, for example with our cleaner or a service provider you have asked us to arrange, or where the law requires us to.
10.4There are no cameras inside the home. [Any external cameras, e.g. at the gate or driveway, must be listed here.]
11. Complaints
If something isn’t right, please tell us during your stay so we have a chance to fix it. Most issues can be sorted out the same day. If you are still not happy, email us and we will reply within 5 business days. You can also contact NSW Fair Trading.
12. General
12.1These terms are governed by the laws of New South Wales, Australia.
12.2We may update these terms from time to time. The version in place when you made your booking is the one that applies to your stay.
12.3If any part of these terms can’t be enforced, the rest still applies.
